Mr Housden the senior planning manager is putting forward the new46m high (151 feet) giant swing as essential, and fitting in with the parks landscape, Mr Housden said Flamingoland’s existing rides were “an accepted feature on the landscape” and identify it as a major national tourist attraction.

The couple who live 100 yards from the Farley entrance, have been waging the battle since 2002, and are looking to seek damages from Alton Towers over the noise generated by the park since 1998. The claim was thrown out in January 2011, with everyone thinking that it was finally over, however still going now today’s case will cost the park £8500 in court fees.

On this basis though in July last year the judge said he wouldn’t grant a protective cost order, which would mean should the Ropers lose, they would be in line for the full costings of Tussaud’s during the case, which could have serious impact on the couple.

That being said although the park brings in much money to the area, and supports jobs locals are generally not bothered by the noise of the park, just with the traffic becoming an issue. This was helped by the park contributing towards the upkeep of the road and transport links earlier this year.

Currently the park can operate on 2 days a week until 1am in the Dome, this has been used for concerts and the night promotions, mainly during the summer months. But locals have expressed there horror that this may be the case until 3am, 7 days a week.

Linda Thomas, 69, “It has not always been bad. In the daytime, you can hear the screams and the loudspeaker announcements, and you are used to that”.

“But we are certainly losing sleep. Last summer the noise was going on until 1am but that was mainly at the weekends. But this application is for every day of the week. If they are allowed to stay open until 3am, it will affect us very badly”.

A spokesman for the Park has said: “We want our guests to have the best possible experience when they visit but we also want to ensure our neighbours can enjoy the peace and quiet of their homes”.

whilst residents do have a direct hotline to the park encase of any problems, the latest requests go in front of committee in the next couple of months.

The wooden pier fire was reported at around 1.45pm with beams and cladding being alight for just under two hours . An investigation is underway with arson most likely for this recent fire, with previous fires also reported at the park since it’s closure.

The park closed to the public in 2007, with recent plans for redevelopment put on hold in 2011 as not being suitable for the local community.

Pleasureland owner Norman Wallis, who took on the park in 2007 larked around for photos on the launch of the new Log Flume,  Piranha River Ride. Since the closure of the parks old Log Flume, plans have been in place for the new one to open with this weekend being the opening time.

Mr Wallis, 48, was left red-faced and soaking and joked: “I’m glad there are no real piranhas in there.
“I hope that is all the bad luck that will be coming my way today.
“In all my years I have never experienced a Friday the 13th mishap but I’m glad I can laugh at it and I’m not nursing any bruises or broken bones.”

Obviously there for the publicity he states the ride is perfectly safe, with no chance of falling into the pool!

The new ride is now open at New Pleasureland Southport.
